Terms of Service

1. Scope

These Terms of Service apply to all orders placed through the SongStory websites. SongStory is operated by K&E Commerce Limited, Hong Kong (“we”, “us”). Our contact details are set out in our Legal Notice. By placing an order, you accept these terms in the version published at the time of your order.

2. Our service

We create personalised songs based on the information you provide. Songs are produced using our own production process, which may include automated tools. Each song is individual; its content, style and wording may vary and depend on the information you provide.

Before purchasing, you may listen to a free preview. Requesting a preview does not create any obligation to purchase.

3. Orders and contract

The products presented on our websites do not constitute a binding offer. By completing checkout, you submit a binding order. The contract is concluded when we accept your order or deliver your song. We may decline orders at our discretion; in that case, any payment made will be refunded.

4. Prices and payment

Prices are shown in the applicable currency at checkout. Taxes are included or added as shown at checkout. Payment is processed by third-party payment providers, whose terms also apply.

5. Delivery

Songs are delivered digitally. We will send you a link by email once your song is ready. Delivery times stated on our websites are estimates; we make reasonable efforts to meet them, but minor delays do not entitle you to compensation. If we are unable to deliver your song, we will refund the price paid.

You are responsible for providing a correct email address. Digital access may be limited in time; please download your song.

6. Changes to your song

One round of changes is included with each purchased song, to be requested within a reasonable time after delivery. We decide how changes are implemented. Additional changes are not included.

7. Your information

You are responsible for the information you provide and confirm that you are entitled to share it, including information about other persons, and that it does not infringe the rights of third parties or applicable law. We may refuse or cancel orders with unlawful, offensive or otherwise inappropriate content.

You grant us the rights necessary to use the information you provide for the purpose of creating, delivering and improving our service.

8. Rights to the song

All rights in the songs, including copyright, remain with us or our licensors. Upon full payment, you receive a non-exclusive, non-transferable licence to use your song for private, non-commercial purposes, including sharing it with family and friends. Any commercial use, resale, public distribution or publication on streaming or similar platforms is not permitted without our prior written consent.

9. Right of withdrawal

Our songs are digital content created individually according to your specifications. By placing an order, you request that we begin performance immediately and acknowledge that, to the extent permitted by law, a statutory right of withdrawal does not apply or expires once performance has begun. Mandatory statutory rights remain unaffected.

10. Warranty

If a delivered file is technically defective, we will replace it. Dissatisfaction with artistic or stylistic aspects does not constitute a defect. Further warranty claims are excluded to the extent permitted by law.

11. Liability

To the extent permitted by law, our liability is limited to the amount paid for the order concerned. We are not liable for indirect or consequential damage, lost profits, or damage caused by slight negligence, by third-party services or by circumstances beyond our control. Liability for intent and gross negligence and mandatory statutory liability remain unaffected.

Information on how we process personal data is provided in our Privacy Policy.

13. Changes to these terms

We may amend these terms at any time. The version published at the time of your order applies to that order.

14. Governing law and jurisdiction

These terms are governed by the laws of the Hong Kong Special Administrative Region, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of Hong Kong have jurisdiction. Mandatory consumer protection provisions of your country of residence remain unaffected.

15. Severability

If any provision of these terms is invalid, the remaining provisions remain in effect.
